The purpose of the presented paper is to showcase the links between Hans-Hermann Hoppe’s libertarian argumentation ethics and Karl-Otto Apel’s transcendental pragmatics with a special reference to the consensus theory of truth proposed by the latter thinker. More specifically, the author contends that Hoppe’s theory is logically contingent on Apel’s views on truth in that some crucial gaps in Hoppe’s grounding of the so-called “a priori of communication and argumentation” are filled by Apel’s original arguments. Additionally, the paper provides (...) a case for interpreting Hoppe's ethics as a theory of rational conflict-freedom, which seems to cohere best with the transcendental-pragmatist approach. Finally, the author offers a few remarks on how the most common objections against Hoppe's theory can be overcome on the basis of the transcendental pragmatics and the conflict-freedom principle. In this article I try to investigate the possible insights one may reach by considering the development on the level of socio-philosophical theories as a symptom of the development taking place on the level of social practice.

As a consequence of the successful 1984 meeting of these two research groups at Bochum - the proceedings of which have been published as Hegels Rechtsphilosophie im Zusammenhang der europäischen Verfassungsgeschichte, edited by Hans-Christian Lucas and Otto Pöggeler - this conference constituted a further step toward continuous cooperation between French and German Hegel scholars. It was held in Poitiers on December 3–5, 1986, at the CRDHM, which, since its founding in 1970 by Jacques D’Hondt, its first director, has coordinated (...) the translation of Hegel into French and published its Bulletin to provide information about all aspects of Hegel and Marx research. The conference was excellently organized by its host, Guy Planty-Bonjour, and by Hans-Christian Lucas and Otto Pöggeler on the German side, with funding from the Centre National de la Recherche Scientifique and from the University of Poitiers. During the three full days of the meeting, about ten scholars from each side had a splendid opportunity to discuss not only the twelve papers presented, but also numerous other aspects of their work. Certain palaeontological observations, of which some examples are described do not fit in either a Lamarckian or Darwinian view of evolution. Both of these mechanistic theories assume small character-changes in the end stages of ontogeny, which gradually accumulate and are supposed thus to have given rise to all evolutionary progress. Palaeontology, on the other hand, teaches that the fundamental qualitative changes in the morphological plan have taken place in a saltatory manner in more or less young ontogenetic stages . Only (...) after the morphological plan has been built in a phylogenetic phase of explosive, early ontogenetic changing of type follows a phase of stable, continous evolution. It is shown that, theoretically, no other kind of fundamental change in the organisation is possible and that many, otherwise inexplicable, phenomena, the lack of transition forms, the question of ancestral stocks, the ideas of the biology of organisms as a “whole” etc., find their explanation by this means.Il y a certaines observations paléontologiques, dont l'auteur donne plusieurs exemples, et qu'on ne pourrait mettre d'accord avec un aspect larmarckienne ou darwinienne. Ce sont là des essais mécaniques d'explication, qui comptent avec de petites modifications de caractères dans les derniers stades de l'ontogénèse qui se totalisent peu à peu et devraient ainsi avoir occasionné tout progrès phylogénétique. Par contre, la paléontologie enseigne que les transformations qualitatives profondes des plans de constructions ont évolué par bonds dans les stades ontogénétiques plus ou moins juvéniles . C'est seulement après que les types ont été formés dans une phase phylogénétique de transformation explosive et juvénile, qu'une phase d'une évolution stable et continue vient s'y ajouter. On démontre que théoriquement un autre procédé d'un changement profond d'organisation est absolument impossible et que de cette manière un grand nombre de phénomènes par ailleurs incompréhensibles trouvent de la sorte leurs explications: par exemple l'absence des formes transitoires, la question des formes de racines, les conceptions de la biologie du „tout” de l'organisme etc. (shrink)

Hillel Steiner’s applied theory of territorial rights is part of his broader left-libertarian theory of rights. Steiner believes that all individuals have the libertarian right to self-ownership and to an equal share of the value of (global) natural resources. He thus views territorial rights as being ultimately reducible to the lower-level rights of free and equal individuals. This view challenges most accounts of nationalism (and territorial collectivism) as well as the normative theories of state sovereignty based on them. It thus (...) offers new perspectives on such issues as secession, immigration, and global justice. This article showcases how these ideas generate normative guidelines for solving territorial disputes. Among his concrete institutional proposals, relevant for the contemporary debate, is a globally distributed universal basic income (UBI) funded by the global taxation of natural resources. (shrink)

That devout Marxists would not cast a kind eye on my The Scottish Enlightenment and Hegel’s Account of “Civil Society” is to be expected, for one of the aims of my study was to free the research into Hegel’s social and economic views from the ideological fetters of the past. However, it was a matter of surprise and regret to me to see that, of all journals, The Owl, the journal of the Hegel Society of America, chose to publish a (...) one-sided “Marxist” account of my book, almost a verbatim copy of what appeared in the 1990–91 issue of Science and Society. The ideological nature of this attack upon my book will have been obvious to the attentive reader, for the only authority quoted at any length was neither Hegel nor Ferguson, Hume, Smith, Steuart, nor any of the other thinkers with whom my book is primarily concerned, but Karl Marx. These must be difficult times for hard-line Marxists and this situation should explain if not excuse the bad temper of the attack. For example, the insulting adjective “daft” was applied to my research. This, I think, is unsuitable for any scholarly discussion. I also hold the opinion that a review should try to give some idea of the content of the book under consideration before plunging into violent polemics. Those who would like to get a less dogmatic and more informative account of my study might turn to Hegel-Studien, 1989 ; American Historical Review, 1990 ; Journal of the History of Philosophy, 1991. Those who have attended any Hegel congress in Stuttgart in the past may remember disappointment on seeing the house in which Hegel was born. I well remember my own embarrassment, a few years ago, taking a group of Italians to the 400 years-old house at No. 53 Eberhardstraße. We found nothing to remind us of the philosopher but a miserable plaque. Worse, the ground floor of the building was apparently occupied by a firm specializing in bathroom equipment. This sad and (...) unsatisfactory situation was all the more surprising, given that this house was among the few old buildings not destroyed during World War II. (shrink)
